Terms of Use & Conditions
This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of domain name [www.indianbusinessportal.in] (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”).
By signing up for INDIAN BUSINESS PORTAL or by using our webpage, including our services or any content or information which is provided as a part of the services, you acknowledge that you have read and understood all the terms, conditions and policies governing INDIAN BUSINESS PORTAL, which includes without limitation the terms of this Agreement, INDIAN BUSINESS PORTAL’s Privacy Policy and other Agreements, and that you agree to be bound by all of its provisions. If you are using INDIAN BUSINESS PORTAL on behalf of a firm/enterprise or another legal entity (“Company”), you are nevertheless individually bound by the terms, conditions and policies governing INDIAN BUSINESS PORTAL even if your Company has a separate agreement with us. If you do not agree to the terms of this Agreement (as may be updated from time to time), you may not sign up for INDIAN BUSINESS PORTAL or access, view, download or otherwise use INDIAN BUSINESS PORTAL webpage, content, information or services or may close your existing Account.

By impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Policies ((including but not limited to Privacy Policy available at Privacy) as amended from time to time. The INDIAN BUSINESS PORTAL Platform is owned by FIEO, a company incorporated under the Companies Act, 1956 with its registered office at Niryat Bhawan, Rao Tula Ram Marg, Opp. Army Hospital Research & Referral, New Delhi – 110 057 ( (hereinafter referred to as "INDIAN BUSINESS PORTAL ").
PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use on any device, you also accept and agree to be bound by Policies ((including but not limited to Privacy Policy available at Privacy) as amended from time to time.
Key Terms
User - Any user who navigates and uses INDIAN BUSINESS PORTAL. A user may or may not be signed up with (or have created an Account on) INDIAN BUSINESS PORTAL. A user may use the modules, features, services and content available on the pre-login site of INDIAN BUSINESS PORTAL.
Member - A registered User with INDIAN BUSINESS PORTAL A Member is a user who has signed up with INDIAN BUSINESS PORTAL ; confirmed the email id used as User ID directly or via third party sign ups. A Member who is either inactive or ceases to be associated with a Company may continue to remain a Member so long as his/her user Account is not closed. When a user Account is closed (self-initiated or by INDIAN BUSINESS PORTAL), such user ceases to remain a Member.
Indian Business Portal is a digital platform wherein Exporters & Importers in India and abroad can display online their products and services (hereinafter “Members” or “Merchants”) for potential buyers and sellers to review and generate enquiries. Each member or Merchant may have their own E-stores in the INDIAN BUSINESS PORTAL. Indian Business Portal provides the services of listing catalogues, pricing, shipping, etc. which is informational and it is up to user to follow it or not. Indian Business Portal does not provide any option for sale or purchase. Any sale or purchase can be done on the E Store of the Merchant who is part of the INDIAN BUSINESS PORTAL and is direct contract between User and the Merchant, subject to Terms as well as T&Cs in general. Indian Business Portal may help facilitate the resolution of disputes through various modes.
The Website is an electronic platform in the form of an electronic marketplace and an intermediary that (a) provides a platform for Users (who are sellers) to advertise, exhibit, make available and offer to sell various Products to other Users (who are buyers/customers), and (b) a platform for such other Users to accept the offer to sell of the Products made by the sellers on the Website, and (c) services to facilitate the engagement of buyers and sellers to under commerce on the Website, and (d) such other services as are incidental and ancillary thereto.
Indian Business Portal has no control over: (a) the existence, quality, safety or legality of items displayed; (b) the accuracy of third party content or listings including that of registered Merchants; (c) the ability of Merchant’s or sellers to sell items; (d) the ability of buyers to pay for items. Indian Business Portal does not, at any point of time, take the ownership of any of the goods offered by the Merchant or seller. Nor does Indian Business Portal, at any point, assert any rights or claims over the goods or services offered by the Merchant or seller to the buyer.
In using the online service, User explicitly agrees and acknowledges that:
c. Before accepting shipment of any product, kindly ensure that the product’s packaging is not damaged or tampered. If User observes that the package is damaged or tampered, Indian Business Portal requests User to refuse to accept delivery and inform Indian Business Portal at the earliest.
d. Content: Content on the Indian Business Portal is displayed on “AS IS” basis, in the form received from the Merchants. While Indian Business Portal tries to offer reliable data, Indian Business Portal cannot promise that the catalogues will always be accurate and up-to-date, and User will not hold INDIAN BUSINESS PORTAL responsible for inaccuracies in the catalogues.
e. Limitation of liability and waiver: In no event, Indian Business Portal will be liable to User for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation lost business opportunities, lost revenues, or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever
f. Dispute Resolution: If any dispute, controversy or claim arises under this Agreement or in relation to Indian Business Portal including any question regarding the existence, validity or termination of this Agreement or T&Cs, the parties shall use all reasonable endeavours to resolve such Dispute amicably. If the parties are unable to resolve the Dispute amicably within 30 days of the notice of such Dispute, Indian Business Portal may elect to resolve any Dispute by a binding arbitration in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996 (hereinafter Act).
g. Jurisdiction: Subject to the Dispute Resolution section above, User agree that any claim or dispute User may have against Indian Business Portal must be resolved by a court having jurisdiction in New Delhi, India. User agree to submit to the personal jurisdiction of the courts located within New Delhi, India, for the purpose of litigating all such claims or disputes. This Agreement shall be governed by Indian law. This paragraph shall survive termination of this Agreement
h. Indian Business Portal amongst others, shares information with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to User, managing and enhancing customer data, providing customer service, and conducting customer research or satisfaction surveys. Any such sharing will be in compliance with applicable laws and these companies are obligated to protect User personal information.
It shall be the responsibility of the Merchant to make the Customer aware of its various applicable policies like return/refund/replacement/repair/exchange/warranty/guarantee/usage etc. and also to make the same as part of the invoice.
NOTE: Indian Business Portal reserves the right to modify these T&Cs from time to time, with or without notice of the same. Hence, User are requested to keep checking the T&Cs regularly.
Member Responsibility
a. Personal Use of Services
Use of INDIAN BUSINESS PORTAL services are restricted to your and your Company’s use as outlined in this Agreement only and not for commercial benefit.
User may use the Service(s) only for his/her personal use, and/or that of their Company, only to the extent that he/she represent and warrant that he/she have the legal authority to agree to and accept this Agreement on behalf of Company. The Service is not intended for or licensed for any commercial use. We reserve the right to cancel any or all of the Services at any time at our sole discretion without any notice or liability to User or any other person.
The download of the whole or significant portions of any functionality of the Service(s), or any part of the Service(s) is prohibited; online or other republication of content is prohibited; and any violation may result in immediate termination of your membership and may result in legal action for injunction, damages, or both. Elements of the Service are protected by trade dress and other applicable laws and may not be copied or imitated in whole or in part. All other product names, Company names, marks, logos, and symbols used in the Services may be the trademarks of their respective owners and may be protected by copyrights, trademarks, or other intellectual property rights and other applicable laws.
You may use Indian Business Portal only for lawful purposes and perform no illegal actions, which may harm Indian Business Portal, its partners, affiliates, members, DigiVation & GlobalLinker in anyway. User will not use GlobalLinker to study or understand the functionality to create a Company product or competitive product.
A Member joining Indian Business Portal also creates or becomes a part of their Company network on FIEO GlobalLinker. Registering with FIEO GlobalLinker provides you access to a host of services and benefits.
User will provide true and accurate information about themselves and their Company
User may avail of Indian Business Portal / FIEO GlobalLinker services by creating an Account for his/her Company (if one does not already exist) and for yourself. User must be 18 years or older to become a Member and/or to use the Service(s) available on FIEO GlobalLinker or Indian Business Portal. By registering user indicates Agreement to the terms of this Agreement on the Sign-Up page and confirm to be over 18 years of age.
As part of the Sign Up process, user will create Account by providing a unique email address (“Username”) and password directly to the platform or via third-party sites (including but not limited to Facebook, Google). This will allow a ‘single sign-on’ to all of GlobalLinker functions, except those that require additional authentication and it is user responsibility to exercise caution while selecting and managing your GlobalLinker single sign-in credentials.
Only verified members, and who have created or are a part their company network on GlobalLinker, will have access to GlobalLinker and all features. Until then, members will have limited access to their accounts and prompted to complete the ‘membership’ process to gain complete rights.
FIEO GlobalLinker, Indian Business Portal or DigiVation are not responsible for the loss or compromise of user sign-in credentials or for any other unauthorized access. User must also provide accurate, complete, and updated registration information. Failure to do so will mean a violation of the terms of this Agreement. User understand that they may not (i) select or use a name of another person with the intent to impersonate that person; or (ii) use a name that Indian Business Portal, in its sole discretion, deem offensive.
Indian Business Portal may in its discretion at any time require proof of identity of any person seeking to access and use FIEO GlobalLinker or Indian Business Portal, and may deny access to it or parts of it or refuse to accept or act upon any communication if not satisfied with such proof. Additionally, FIEO GlobalLinker also reserves the right to remove or reclaim a Username if we believe it is appropriate.
User should keep their Account secure by creating a password which is difficult to crack. In addition user must not share any Account details and keep it confidential, and take all measures to keep sign in credentials confidential. Distribution of the access password to others is expressly prohibited and shall constitute a violation of this Agreement. Any fraudulent, abusive, or otherwise illegal activity may be sufficient ground for termination of the membership, at our sole discretion, and user may be referred to appropriate law enforcement agencies. Indian Business Portal will not be liable for any loss that may be incurred by user as a result of unauthorized use of password or Account, either with or without knowledge. User shall not use anyone else's password at any time. Indian Business Portal is not under any obligation to verify the actual identity or authority of any person using Username and password to access and use Indian Business Portal and may act upon any communication that is given with the use of the password.
(a)User shall notify us by e-mail at ibp@fieo.org of any known or suspected unauthorized use(s) of the membership, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of password or credit card information or any other information.
(b) User will be responsible for maintaining the confidentiality of your password. You never will be required to reveal your password to any representative or agent of Indian Business Portal, its owners or agents or other Members.

Content submitted by user should not be in breach of any copyright or intellectual property rights.
As part of its Service, Indian Business Portal allows Members to post messages on the discussion forum (including as a part of “Biz Forum”, “Company Buzz”, “Groups” ), job boards, and/or classified advertisements, to buy and sell "leads," to ask and answer questions to other Members, and to upload photos, files, information, logos and editorial matter to their Company Profile, chats. Indian Business Portal claims no ownership rights in any content, editorial matter, image or file uploaded to the Service by user. For the sole purpose of displaying files/information/profile/content to recipients, including those designated by user, user grant to Indian Business Portal a perpetual, non-exclusive, royalty-free license to copy and/or distribute these through the Service(s) and when user post content or comment or reply to a comment/question in the Biz Forum, permit to display and distribute the content, and to use it for advertising and promotion.
User agrees to submit only content (including but not limited to, images, or any other content) owned and that will not violate the property or other rights of other people or organizations. User hereby acknowledge that content, including images, even if submitted to a site/forum/association of which user is a member, but belongs to the creator or author of the content and user should not reproduce it without permission of the creator or author. (For example, user may not upload an image of your products unless user has the permission of the photographer who has taken the picture - this is because, although user may have physical ownership of the print or graphic file, the copyright is owned by the person who created the image.)
User agrees that the content posted does not offend any section on grounds of gender, caste and other socio-economic sensitivities, and the language and images used as a part of such contributions shall be professional without the use of any slander, expletives or foul language.
Content posted by user/member is public and may be used for distribution by Indian Business Portal.
DO NOT add information which you deem confidential
Any communications, submissions, and any other material unless deemed personal by law, including, but not limited to Company information, suggestions, ideas, drawings, concepts, feedback, comments, or other information posted on Indian Business Portal or FIEO GlobalLinker shall not be subject to any obligation of confidentiality whatsoever and will be treated as non-proprietary and non-confidential (even if marked confidential or similar denotation). DO NOT POST PRIVATE OR COMPANY CONFIDENTIAL MATERIAL. Indian Business Portal shall not be liable for any use or disclosure of any such submissions or communications and reserves the non-exclusive right to edit, copy, publish, and distribute any information or content you transmit or submit to it for any purpose whatsoever without providing any attribution or compensation for using the same.
To facilitate network and a growth oriented environment, all Members are expected to respect each other. Always treat other Members with courtesy and respect when posting messages, commenting or replying to the discussions, queries, articles, invitations or messages. User will not disrespect or insult any Member or Company due to their origins, religion, caste, race etc. and not use abusive language, expletives and words.
Please avoid shouting (using all capital letters) in discussion forums or any negative form of communication.
All applications, use of software are governed by the Terms of this or each Agreement.
If you use or receive software or download applications from Indian Business Portal or FIEO GlobalLinker as part of the Services (“Software”), it is governed either by specific license for the software, if any, presented by FIEO GlobalLinker or if no license is presented, the terms of this Agreement and the TOS, if any, apply to the Software. The Software is licensed, not sold, and Indian Business Portal /GlobalLinker reserves all rights to the Software not expressly granted, whether by implication, estoppel, or otherwise.
In addition to the other restrictions in this Agreement, user may not circumvent or bypass any technological protection measures in or relating to the Software or disassemble, decompile, or reverse engineer any Software that is included in or accessible through the Services.
User shall not use any deep-link, robot, spider, or other automatic devices, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or Content (as defined below), or in any way reproduce or circumvent the navigational structure or presentation of the Website, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the Website.
No Linking, Framing, Mirroring, Scraping, Data-Mining or Postings
Links to Indian Business Portal without the express written permission are strictly prohibited. To request permission to link, please send an email to ibp@fieo.org. Indian Business Portal may in its discretion cancel and revoke any permission it may give to a link at any time and without any notice or liability. The framing, mirroring, scraping or data-mining of Indian Business Portal or posting any of its content in any form and by any means in violation of terms hereof is strictly prohibited.
Indian Business Portal respect and value your privacy, hence have created a privacy policy to safeguard your interests. Please review Indian Business Portal Privacy Policy. The terms of GlobalLinker's Privacy Policy are considered part of, and are hereby incorporated by reference into this Agreement.
Indian Business Portal may use Cookies and Updates to provide user with a seamless and rich browsing experience. Please view Cookie Policy which outlines use of cookies. Indian Business Portal and/or the third party service provider may automatically check your version of the Software, and add cookies to your browser and may also automatically download updates to the Software from time to time. User agrees to accept such updates subject to these terms unless other terms accompany the updates. If so, then such other terms shall apply. Indian Business Portal isn't obligated to make any updates available and doesn't guarantee that we will support the version of the system for which you licensed the Software. Such updates may not be compatible with software or services provided by third parties.
User agrees, understand, and acknowledge that the Indian Business Portal Website is an electronic platform and an intermediary that provides an electronic venue where various Users may electronically meet and interact with each other to engage in commerce and transact. Indian Business Portal is only a facilitator and is not and cannot be a party to or control in any manner any advertisement, exhibition, making available, offer to sell, or transactions of sale or purchase of Products on the Website. Indian Business Portal is not the seller of the Products. Accordingly, any contract for the sale/purchase of Products on the Website is a bipartite contract between User and the sellers or User & Buyer. Indian Business Portal does not recommends nor endorses any one to buy or sell any Products and nor does provides any guarantee, warranties, or assurance with respect to the advertisement, exhibition, making available, offer to sell or transactions of sale or purchase of Product.
User is solely responsible to Indian Business Portal and to any third party for any breach of its obligations under these Terms of Use or other Agreements and for the consequences (including any loss or damage which Indian Business Portal or its affiliates or its vendors may suffer) for any such breach
Indian Business Portal Linker.Store
Indian Business Portal offers Linker.Store as a feature to help members create and manage an online store and sell products and services. Any store set up will ensure that the goods and services offered on the stores will not
i.Promote or threaten to promote hate or violence against any person based on race, ethnicity, color, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status or other forms of discriminatory intolerance.
ii.facilitate or promote activities that contravene, the laws of the jurisdiction of the country
iii.Exploit, harass, abuse or defame any person and children in specific. This will also include and not limited to images or depictions of child abuse or sexual abuse, or in a sexual manner.
iv.infringe on the copyright or trademarks of others
v.transmit malware or host phishing pages
vi.promote self harm
vii.promote any goods and services restricted by the laws of the country
Indian Business Portal may, at any time and without notice, remove any Materials, and suspend or terminate the Account or access to the Services if such activities are outside the scope of Services. Indian Business Portal is not responsible for quality, durability, reliability or the ability of the members(s) to deliver the product or service mentioned. It hereby specifically disclaims any quality, durability, accuracy, reliability and all express or implied warranties including but not limited to warranties of title, merchantability, fitness for a particular purpose or performance.
Indian Business Portal is not party to any of the transactions that may happen between the various member or user of the platform or to any agreement for sale or supply of goods or services between members and/or users. No representation or warranties expressed or implied or statutory is being provided to any member/user for any kind of Product or Services offered, or displayed or hosted on the Site. All such warranties, representations, conditions and undertakings are hereby excluded. Under no circumstances shall Indian Business Portal be held liable for any delay or failure or disruption of the content or services delivered through the Site resulting directly or indirectly from acts of nature, forces or causes beyond our reasonable control, including without limitation, internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strike, labor disputes, riots, insurrections, civil disturbances, shortage of labor or materials, fires, flood, storms, explosions, acts of God, war, governmental actions, order of domestic or foreign courts or tribunals or non-performance of third parties or other force majeure condition. Under no circumstances will Company be liable, direct, indirect, incidental, special, consequential or exemplary damages including but not limited to, damages for loss of profit, goodwill, use, data or other intangible losses arising out of or in connection with the use of the Services provided by Company (“Damages”) whether arising out of or in connection with or otherwise in relation to any business or other transaction conducted in relation to the Service(s).
The Member and/or User hereby indemnifies and holds Indian Business Portal and Digivation harmless against any and all losses, claims, injuries and Damages that may arise out of the Member or User’s breach of this Disclaimer and/or the Agreement.
FRAUD WARNING
All Members and Users are advised to be very careful while doing business with individuals, body corporates or companies from any part of the world. All are advised to exercise reasonable caution and undertake thorough due diligence on such organization and/or individual while transacting with a prospective buyer or a seller on the Site. All members or users are advised extreme caution while exercising any commercial transactions.
Neither Indian Business Portal nor directors, employees, officers or agents of FIEO or Digivation shall be liable to any member or user or otherwise for any illegal or fraudulent interaction or transaction with organizations and/or individuals located on or through the Site.
Content Monitoring
Indian Business Portal do not monitor content, but will not hesitate to remove any material if it violates the letter or spirit of this Agreement. Indian Business Portal does not actively monitor a Member's uploaded files, Company Profiles, and other material nor does exercise any editorial control over the content of any material that the Member uploads. However, Indian Business Portal reserves the right to remove any and/or all of the Member's material that are in it's sole discretion, potentially illegal, a violation of trademark and/or copyright, obscene, indecent, defamatory, incites racial or ethnic hatred, violates the rights of others or otherwise violates the acceptable use policy stated below in this Agreement. Upon removal of the material, Indian Business Portal may notify the Member of the removal of the materials, as well as the reason for removal. In no instance shall Indian Business Portal be liable for the removal of the materials. Indian Business Portal reserves the right to immediately terminate its Service to Member and cancel his/her membership for any flagrant or repeat violations of this Agreement.
Indian Business Portal Indemnity, Warranty and Liability
Indemnification of liability
User / Member will indemnify Indian Business Portal and those associated with it against any losses incurred by you or your Company and for any damages due to performance failures. Indian Business Portal employs and will, in future, introduce means to ensure Companies registered on Indian Business Portal are genuine. Users are advised to use caution and perform own validation before entering into transactions with such companies. Indian Business Portal assumes no liability or damages for any losses (in any manner) faced by you while dealing with a Company and its Company Members (including Verified Companies). In no event will Indian Business Portal, its owners, employees, contractors, subcontractors, suppliers, agents, Affiliate Partners, subsidiaries, successors or assigns be liable to any party for any direct, indirect, consequential, incidental, special or other indirect Content or other materials provided or available hereunder (including without limitation, cost of cover), arising out of or in connection with this Agreement or any Services, Content or other materials provided or available hereunder, even if such party was expressly advised of the possibility of such damages, and regardless of whether such damages arose in contract, tort (including negligence), strict liability or other legal basis.
Disclaimer of Warranty and Limitations of Liability
No warranties are provided for facilities, features services and products etc. availed of by user on Indian Business Portal. Indian Business Portal and its associated Services are provided on an "as is," "with all faults" and "as available" basis without representations or warranties of any kind, either express or implied, including, but not limited to, accuracy, timeliness of information available from the Services, implied warranties of merchantability, fitness for a particular purpose or audience, and non-infringement, communication with Members and Users by Indian Business Portal. In no event will Indian Business Portal, FIEO or DigiVation or its promoter(s) or partner(s) or directors, officers, employees, affiliates, or agents be liable to you or any third party for any incidental, indirect, special, or consequential damages (even if you were advised of the possibility of such damages), arising out of your use of or inability to access or use the Service(s), including without limitation, loss of revenue or anticipated profits, loss of goodwill, lost business, lost data, computer failure or malfunction, or any and all other damages or losses that result from mistakes, omissions, interruptions, deletions of files, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not limited to acts of god, communications failure, theft, destruction, or unauthorized access to Indian Business Portal's records, programs, or services. If you are dissatisfied with any portion of Indian Business Portal or the Service(s), or with any of the terms of this Agreement, your sole and exclusive remedy is to discontinue using the Service or close your Account. It is further clarified that in jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, Indian Business Portal total liability shall not in any event exceed the registration/listing fees paid, if any, by the Member for registering/signing up with Indian Business Portal or availing the Service(s).
Laws, Disputes & Arbitration
a. Compliance with Laws
User must comply with all applicable laws. You agree to comply with all applicable laws, rules, and regulations in connection with your activities under this Agreement, including and without limitation the applicable regulations under the Foreign Trade Policy of India, as amended to assure that the Content is not exported in violation of Indian laws.
Any legal dispute shall be subject to the exclusive jurisdiction of New Delhi courts This Agreement shall be governed by and construed in accordance with the laws of India. Any claim, cause of action or dispute (“claim”) arising out of or related to this Agreement shall be determined by the competent courts at New Delhi only.
Any unenforceable terms will not disallow the others from being enforced and terms may be replaced If any provision of this Agreement is determined by any court of competent jurisdiction to be unenforceable, such provision shall be interpreted to have the broadest application as shall be enforceable. Further, Indian Business Portal shall also have the right to replace those terms with similar terms to the extent enforceable under the relevant law. The unenforceability of any particular provision of this Agreement shall not affect any other provision hereof, which shall continue in full force and effect.
Indian Business Portal will cooperate with applicable laws and authorities as required and will cooperate with any and all appropriate legal authorities in investigating claims of illegal activity, including, but not limited to illegal transfer or use of copyrighted material or other illegal activity. Indian Business Portal reserves the right to monitor or view material uploaded by Members on Indian Business Portal at any time for the purpose of ensuring compliance with this Agreement.
Changes to the Terms of Use/User Agreement
Our terms will be updated on a regular basis and we may notify you of such changes. Indian Business Portal reserves the right, at its sole discretion, to update, add, remove, change, modify, revise the terms of this Agreement from time to time without prior notice on an as-needed basis by placing an update of this Agreement online at Indian Business Portal or at any other designated location at Indian Business Portal. Revisions/changes to this Agreement will be effective when posted on Indian Business Portal and we may notify you of these revisions, however, you shall be responsible for regularly reviewing the terms of this Agreement. By using Indian Business Portal after any revision of the terms of this Agreement, you agree to be bound by such changes/revisions. This Agreement creates a binding legal Agreement, so please read the same carefully. If you do not agree to these changes/revisions, you must immediately discontinue using Indian Business Portal.
Non-acceptable Actions on Indian Business Portal
You may not use Indian Business Portal for unlawful and abusive purposes. Incidents and uses that may cause your Account to be terminated include, but are not limited to:
Use of Indian Business Portal and/or the Services in any manner prohibited (both express and implied) by this Agreement and/or the relevant TOS.
· Uploading or transmission of any data or material that contains trojans, worms, viruses or any code of a destructive or spying nature, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware or host or network.
· Removing any proprietary notices or label on any Content, or using the Service in conjunction with any device or service designed to circumvent technological measures employed to control access to, or the rights in, any Content or other work protected under copyright laws.
· Uploading or transmission of any file or content that harm minors in any way, including any form of child pornography.
· Uploading or transmission of any file or content that spreads messages of terror or depicts torture or death-images.
· Uploading or transmission of files intended to threaten or harass any individual or organization.
· Using the Service for any purpose other than which it is intended.
· Using the Service for submission, generation or inclusion of unsolicited bulk email or other forms of email abuse (i.e. SPAM).
· Using the Service for advertising, trading of goods or services, or other commercial use except as permitted by Indian Business Portal.
· Attempting to impersonate any person or Company, using forged headers or other identifying information in a defamatory way.
· Uploading any programs that may cause a disruption to the Service
· Any action that violates the laws of applicable local, state, federal or international governmental bodies.
· Sharing the Account with anyone or re-selling the Service without express written permission from Indian Business Portal.
· Use of Indian Business Portal and/or Services and/or linked websites in any manner that, could damage, disable, overburden or impair it or interfere with any other Members or party's or use and/or enjoyment of and/or Services and/or linked websites.
· Obtaining or attempting to obtain any materials or information through any means not intentionally made available or provided for or through Indian Business Portal or company Network' in your settings.

INDIAN BUSINESS PORTAL Platform is owned by FIEO, a company incorporated under the Companies Act, 1956 with its registered office at Niryat Bhawan, Rao Tula Ram Marg, Opp. Army Hospital Research & Referral, New Delhi – 110 057 ( (hereinafter referred to as "INDIAN BUSINESS PORTAL ").
Indian Business Portal is a digital platform wherein Indian Exporters can display online their products and services (hereinafter “Members” or “Merchants”) for potential buyers and sellers to review and generate enquiries. Each Indian Exporter may have their own Digital stores or E-stores in the INDIAN BUSINESS PORTAL. Indian Business Portal provides the services of listing catalogues, prices, offers etc. which is informational and it is up to you to follow it or not. Indian Business Portal does not provide any option for sale or purchase. Any sale or purchase can be done on the E Store of the Merchant who could be part of the Indian Business Portal and is direct contract between you and the Merchant, subject to Terms as well as T&Cs in general.
By signing up for INDIAN BUSINESS PORTAL or by using our webpage, including our services or any content or information which is provided as a part of the services, you acknowledge that you have read and understood all the terms, conditions and policies governing INDIAN BUSINESS PORTAL, which includes without limitation the terms of this Agreement, INDIAN BUSINESS PORTAL’s Privacy Policy and other Agreements, and that you agree to be bound by all of its provisions. PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use on any device, you also accept and agree to be bound by Policies including but not limited to Privacy Policy as amended from time to time.
Registering (sign up) with Indian Business Portal
Registering with Indian Business Portal could provide you access to a host of services and benefits. By registering you indicate Agreement to the terms of this Agreement on the Sign-Up page and confirm to be over 18 years of age.
By signing up for INDIAN BUSINESS PORTAL, you could either sign as Guest or as Member.
- Guest is any user who may or may not be signed up with (or have created an Account on) INDIAN BUSINESS PORTAL and may use the modules, features, services and content available on the pre-login site of INDIAN BUSINESS PORTAL.
- Member - is any user who has signed up with INDIAN BUSINESS PORTAL as a registered user. You agree to provide true and accurate information about yourself during the registration process ("My Account") at the website. If we have reasonable grounds to believe that the information provided to Indian Business Portal is untrue or inaccurate, we reserve the right to suspend or terminate your account and refuse you any and all current use or future use of the website (or any portion thereof).
As part of the Sign Up process, you will create Account by providing a unique email address (“Username”) and password directly to the platform or via third-party sites (including but not limited to Facebook, Google). Only verified members, and who have created or are a part their company network will have access to Indian Business Portal and all features. Until then, members will have limited access to their accounts and prompted to complete the ‘membership’ process to gain complete rights.
Indian Business Portal is not responsible for the loss or compromise of your sign-in credentials or for any other unauthorized access. You must also provide accurate, complete, and updated registration information. Failure to do so will mean a violation of the terms of this Agreement. You understand that they may not (i) select or use a name of another person with the intent to impersonate that person; or (ii) use a name that Indian Business Portal, in its sole discretion, deem offensive. Indian Business Portal may in its discretion at any time require proof of identity of any person seeking to access and use Indian Business Portal, and may deny access to it or parts of it or refuse to accept or act upon any communication if not satisfied with such proof. Additionally, Indian Business Portal also reserves the right to remove or reclaim a Username if we believe it is appropriate.
Content
You agree to submit only content (including but not limited to, images, or any other content) owned and that will not violate the property or other rights of other people or organizations. You hereby acknowledge that content, including images, even if submitted to a site/forum/association of which you are a member, but belongs to the creator or author of the content and you should not reproduce it without permission of the creator or author. (For example, you may not upload an image of your products unless you have the permission of the photographer who has taken the picture - this is because, although you may have physical ownership of the print or graphic file, the copyright is owned by the person who created the image.)
As part of its Service, Indian Business Portal allows Members to post messages on the discussion forum (including as a part of “Biz Forum”, “Company Buzz”, “Groups” ), job boards, and/or classified advertisements, to buy and sell "leads," to ask and answer questions to other Members, and to upload photos, files, information, logos and editorial matter to their Company Profile, chats. Indian Business Portal claims no ownership rights in any content, editorial matter, image or file uploaded to the Service by user. For the sole purpose of displaying files/information/profile/content to recipients, including those designated by you, user grant to Indian Business Portal perpetual, non-exclusive, royalty-free license to copy and/or distribute these through the Service(s) and when you post content or comment or reply to a comment/question in the Biz Forum, permit to display and distribute the content, and to use it for advertising and promotion.
Indian Business Portal does not actively monitor a Member's uploaded files, Company Profiles, and other material nor does exercise any editorial control over the content of any material that the Member uploads on Indian Business Portal. However, we reserve the right to remove any and/or all of the Member's material that are in it's sole discretion, potentially illegal, a violation of trademark and/or copyright, obscene, indecent, defamatory, incites racial or ethnic hatred, violates the rights of others or otherwise violates the acceptable use policy including usage of any slander, expletives or foul language. Upon removal of the material, Indian Business Portal may notify the Member of the removal of the materials, as well as the reason for removal. In no instance shall Indian Business Portal be liable for the removal of the materials. Indian Business Portal reserves the right to immediately terminate its Service to Member and cancel his/her membership for any flagrant or repeat violations of this Agreement.
Content Confidentiality
Content posted by user/member is public and may be used for distribution by Indian Business Portal.
DO NOT POST PRIVATE OR COMPANY CONFIDENTIAL MATERIAL. Any communications, submissions, and any other material unless deemed personal by law, including, but not limited to Company information, suggestions, ideas, drawings, concepts, feedback, comments, or other information posted on Indian Business Portal shall not be subject to any obligation of confidentiality whatsoever and will be treated as non-proprietary and non-confidential (even if marked confidential or similar denotation). Indian Business Portal shall not be liable for any use or disclosure of any such submissions or communications and reserves the non-exclusive right to edit, copy, publish, and distribute any information or content you transmit or submit to it for any purpose whatsoever without providing any attribution or compensation for using the same.
In using Indian Business Portal, you explicitly agree and acknowledge that:

While Indian Business Portal tries to offer reliable data, Indian Business Portal cannot promise that the catalogues will always be accurate and up-to-date, and you will not hold Indian Business Portal responsible for inaccuracies in the catalogues.
You agree, understand, and acknowledge that the Indian Business Portal Website is an electronic platform that provides an electronic venue where various users/members like you may electronically meet and interact with each other to engage in commerce and transact. Indian Business Portal is only a facilitator and is not and cannot be a party to or control in any manner any advertisement, exhibition, making available, offer to sell, or transactions of sale or purchase of Products on the Website. Indian Business Portal is not the seller/buyer of the Products. Accordingly, any contract for the sale/purchase of Products on the Website is a bipartite contract between You & Seller or You & Buyer. Indian Business Portal does not recommends nor endorses anyone to buy or sell any Products and nor does provides any guarantee, warranties, or assurance with respect to the advertisement, exhibition, making available, offer to sell or transactions of sale or purchase of Product.
You are solely responsible to Indian Business Portal and to any third party for any breach of its obligations under these Terms of Use or other Agreements and for the consequences (including any loss or damage which Indian Business Portal or its affiliates or its vendors may suffer) for any such breach
In no event, Indian Business Portal will be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation lost business opportunities, lost revenues, or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever
Indemnification of liability
You / Member will indemnify Indian Business Portal and those associated with it against any losses incurred by you or your Company and for any damages due to performance failures. Indian Business Portal employs and will, in future, introduce means to ensure Companies registered on Indian Business Portal are genuine. You are advised to use caution and perform own validation before entering into transactions with such companies. Indian Business Portal assumes no liability or damages for any losses (in any manner) faced by you while dealing with a Company and its Company Members (including Verified Companies). In no event will Indian Business Portal, its owners, employees, contractors, subcontractors, suppliers, agents, Affiliate Partners, subsidiaries, successors or assigns be liable to any party for any direct, indirect, consequential, incidental, special or other indirect Content or other materials provided or available hereunder (including without limitation, cost of cover), arising out of or in connection with this Agreement or any Services, Content or other materials provided or available hereunder, even if such party was expressly advised of the possibility of such damages, and regardless of whether such damages arose in contract, tort (including negligence), strict liability or other legal basis.
Disclaimer of Warranty and Limitations of Liability
No warranties are provided for facilities, features services and products etc. availed of by you on Indian Business Portal. Indian Business Portal and its associated Services are provided on an "as is," "with all faults" and "as available" basis without representations or warranties of any kind, either express or implied, including, but not limited to, accuracy, timeliness of information available from the Services, implied warranties of merchantability, fitness for a particular purpose or audience, and non-infringement, communication with Members and Users by Indian Business Portal. In no event will Indian Business Portal, FIEO or DigiVation or its promoter(s) or partner(s) or directors, officers, employees, affiliates, or agents be liable to you or any third party for any incidental, indirect, special, or consequential damages (even if you were advised of the possibility of such damages), arising out of your use of or inability to access or use the Service(s), including without limitation, loss of revenue or anticipated profits, loss of goodwill, lost business, lost data, computer failure or malfunction, or any and all other damages or losses that result from mistakes, omissions, interruptions, deletions of files, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not limited to acts of god, communications failure, theft, destruction, or unauthorized access to Indian Business Portal's records, programs, or services. If you are dissatisfied with any portion of Indian Business Portal or the Service(s), or with any of the terms of this Agreement, your sole and exclusive remedy is to discontinue using the Service or close your Account. Jurisdiction
You agree that any claim or dispute they may have against Indian Business Portal must be resolved by a court having jurisdiction in New Delhi, India. You agree to submit to the personal jurisdiction of the courts located within New Delhi, India, for the purpose of litigating all such claims or disputes. This Agreement shall be governed by Indian law. This paragraph shall survive termination of this Agreement
